Nighttime House Arrest Secured for the Client Instead of Detention in Custody with UAH 800,000 Bail

The Grain Law Firm team has successfully challenged the prosecution’s procedural demands regarding a Client suspected of committing a criminal offense under Part 3 of Article 368 of the Criminal Code of Ukraine (acceptance of an offer, promise, or receipt of an illicit gain by an official).

The pretrial investigation authority insisted on applying the most severe pretrial restriction — detention in custody — with the alternative of bail in the amount of UAH 800,000. During the court hearing, the attorneys refuted the expediency of isolating the individual and demonstrated the excessiveness of the financial burden. Instead, the defense substantiated to the court that significantly more lenient restrictions would be sufficient to ensure proper procedural conduct.

The court denied the prosecutor’s motion for detention and selected nighttime house arrest for the Client. This decision enabled our Client to remain free, subject to nighttime curfew restrictions, allowing him to continue his daily activities during the daytime and communicate unhindered with his defense counsel to prepare their legal positioning.
