Property Rights Protected: Vehicle Returned to the Client
A prosecutor of the Prosecutor General’s Office filed a motion with the court to impose an asset freeze on a MERCEDES-BENZ GLS 400 vehicle (2023 model year, with an estimated value of USD 120,000) for its preservation as physical evidence.
During the court hearing, Alina Davydova, Attorney-at-Law at Grain Law Firm, refuted the prosecution’s position. The defense demonstrated the absence of legal grounds for restricting the property rights, as the Client has no involvement in the circumstances of the criminal proceedings, and the vehicle itself bears no procedural value for the needs of the pretrial investigation.
The Pecherskyi District Court of Kyiv fully concurred with the attorney’s arguments and denied the prosecutor’s motion. The law enforcement authorities’ interference with the Client’s property rights was recognized as groundless, and the owner’s property interests have been fully restored.
