Client Released from 24-Hour House Arrest under Personal Recognizance
The Grain Law Firm team has secured a mitigation of the pretrial restriction for the former Director General of LLC “Zaporizhzhia Titanium-Magnesium Combine”, who is suspected under Part 5 of Article 191 of the Criminal Code of Ukraine.
Despite the prosecutor’s motion to extend the 24-hour house arrest, Attorney-at-Law Alina Davydova convincingly demonstrated its excessiveness. The defense emphasized that a pretrial restriction must ensure proper procedural conduct rather than serve as a form of punishment. It was proven that the Client had duly fulfilled all his obligations, had not obstructed the investigation, and that the risks stipulated by the Criminal Procedure Code had significantly diminished.
The court denied the extension of the 24-hour house arrest and applied the least severe pretrial restriction to the Client—personal recognizance. Furthermore, the obligation to wear an electronic monitoring device was lifted, eliminating excessive interference with our Client’s private life.
