Defense Against a More Severe Pretrial Restriction in a Case Involving Particularly Grave Offenses
The Grain Law Firm team has secured the continued freedom of its Client within criminal proceedings under Part 4 of Article 28, Part 1 of Article 111-2, and Part 2 of Article 255 of the Criminal Code of Ukraine.
The prosecution filed a motion seeking detention in custody without the option of bail; however, Alina Davydova, Counsel and Attorney-at-Law at Grain Law Firm, demonstrated the absence of legal grounds for applying a more severe pretrial restriction. The defense argued that the previously established bail amount serves as a sufficient and effective instrument for ensuring the suspect’s proper procedural conduct.
The court sustained the defense’s position and dismissed the prosecutor’s motion. This successfully prevented the unjustified restriction of the Client’s liberty and preserved their right to freedom of movement.
