Court Denies Extension of Procedural Obligations Imposed on the Client
The Grain Law Firm team has secured the complete release of its Client from procedural obligations previously imposed on him within the scope of a pretrial investigation.
The prosecutor filed a motion with the court to extend the duration of restrictions stipulated by Part 5 of Article 194 of the Criminal Procedure Code of Ukraine regarding a suspect in proceedings under Part 1 of Article 122 of the Criminal Code of Ukraine (intentionally inflicting medium-severity bodily harm). The prosecution cited risks of the individual’s improper procedural conduct.
The defense presented evidence to the court demonstrating the groundlessness of such claims and argued the absence of any objective necessity for the further application of measures of procedural coercion. The investigating judge fully concurred with the attorney’s arguments regarding the prosecution’s failure to prove the stated risks.
The court ruled to completely deny the prosecutor’s motion. All previously established procedural restrictions have been lifted from the Client.
